Buying off-plan
With new developments, security matters as much as the price advantage. Together with you, we review the developer’s past projects, permits and project approvals, the construction servitude (kat irtifakı) status, delivery date and contract terms.
Construction servitude vs. condominium ownership
For off-plan apartments the title deed is usually issued first as construction servitude (kat irtifakı); once the building is completed and the occupancy permit is obtained, it is converted to full condominium ownership (kat mülkiyeti). This distinction matters for mortgages and resale.

Frequently asked questions
Which documents are required to establish construction servitude?
To establish construction servitude (kat irtifakı), an approved architectural project, a site plan, a building permit and the identity details of the owners are required. The application is made to the land registry with these documents.
How does construction servitude become condominium ownership?
Once the building is completed and the occupancy permit (iskan) has been obtained, it is converted to condominium ownership (kat mülkiyeti). If the necessary conditions are met, the conversion can also be done automatically.
Where can I obtain the occupancy permit and the site plan?
The occupancy permit (iskan) and site plan are not issued by land registries. These documents are obtained from the municipality responsible for the property or other competent authorities. The land registry only checks them during the transaction.
